Japan Court Rejects 'Right to Be Forgotten' on Google

Japan’s Supreme Court has rejected a man’s demand that news search results of his arrest on sex charges be deleted from Google, ruling that to do so would violate freedom of expression.

Japanese media said it was the first decision by the nation’s top court involving the “right to be forgotten” relating to Internet searches.

“The deletion (of references to the charge) can be allowed only when the value of privacy protection clearly outweighs that of information disclosure,” the court said in a statement posted on its website.

Tuesday’s decision came after the Saitama District Court, north of Tokyo, in December 2015 upheld a temporary injunction against Google ordering it to delete search results about a man convicted on charges related to child prostitution and pornography.

The Tokyo High Court last July had overturned the lower court decision, saying there was no such legally protected right.

While the top court set strict conditions for allowing the deletion of certain references, it did not mention the “right to be forgotten” recognised in 2016 in overhauled EU rules on Internet data protection.

The Supreme Court said conditions for deleting search engine results include factors such as the degree of damage caused to privacy, how broadly specific searches can be carried out and the social standing of individuals in question.

Tomohiro Kanda, the man’s lawyer, called the decision “disappointing,” saying that ensuring a crime is remembered differs from having the name of a person associated with it “passed on for many years”.

The Japanese office of Google was not immediately available for comment.

Nursery funding: Information Commissioner rejects DfE case

The Department for Education has been told to re-think a decision not to publish key research it used to set new funding levels for free nursery places.

The Information Commissioner has given it 35 days to issue a fresh response to a challenge for the research to be made public.

The government had argued that research carried out by accountants Deloitte was not in its possession to publish.

But the Information Commissioner found that claim to be “not plausible”.

The research fed into the government’s decision on how to set hourly rates for nursery providers offering the free 30-hours nursery place entitlement.

‘Open to scrutiny’

This pre-election pledge by the Conservatives to offer places to working parents of three- and four-year-olds in England is due to come into force next September.

The rates were revealed in the review of childcare costs, which was published last year.

There were more than 50 references to the Deloitte research in that government review, leading the Pre-school Learning Alliance to ask the government to publish the research.

When the government refused, it took the case to the Information Commissioner.

The alliance has been arguing that the average hourly rates for the scheme of £4.88 per hour for four-year-olds and £5.39 for two-year-olds are too low and would make the early years sector unsustainable.

And it argued the Deloitte research was key to setting these rates and therefore should be published.

In its ruling, the commissioner said it was “unlikely that the DfE would commit to investing over £1bn more per year on childcare funding by 2019-2020” as a result of research it had not seen.

He added that if the research was held by Deloitte, then it was held on behalf of the department, and therefore subject to freedom of information requests.

‘Unequivocal’ judgement

Pre-school Learning Alliance chief executive Neil Leitch said: “We are very pleased that the Information Commissioner’s Office has ruled in our favour and agreed that the Department for Education’s argument that it doesn’t hold research that it itself commissioned, and subsequently used, does not wash.

“The research commissioned by the DfE to Deloitte played an integral role in its review of childcare delivery costs, and by extension, the development of the new early years funding rates due to come into effect next year.

“As such, this information should be made public and open to scrutiny, especially given that so many in the sector do not believe that the new funding rates are in fact enough to cover the cost of delivering funded places.

“Given that the ICO was unequivocal in its judgement, we hope that the DfE will now make this research available to us without any further delay.”

The DfE said: “We are currently considering the next steps and will make a decision in due course.”

Oxford head rejects sponsoring schools

The head of Oxford University has rejected calls from the government to sponsor schools.

Louise Richardson says Oxford was “very good” as a university, but had “no experience” of running schools.

The call for universities to help set up schools was part of the proposals to expand grammar schools.

But Prof Richardson said to become involved in the government’s plans for changing schools would be a “distraction from our core mission”.

The government’s Green Paper on grammar schools proposes that universities should have to either sponsor a school or help set up a new school – otherwise they would not be able to charge higher tuition fees.

About 60 universities, including Birmingham and King’s College London, already sponsor or support schools – and the government argues that the expertise of universities should be harnessed to improve schools and drive social mobility.

But Oxford vice-chancellor Prof Richardson said that her university should focus on what it knew best, which was delivering higher education.

Oxford was named as the best in the world in global rankings published on Wednesday.

“We’re very good at running a university. But we have no experience of running schools, so I think it would be a distraction,” said Prof Richardson.

“We’re deeply sympathetic to the idea of social mobility through education – and we have extensive relationships with schools.”

But she said it was “insulting” to head teachers and school leaders to think that universities could step in and do a better job of running schools.

The university revealed earlier this year that it would be admitting the highest proportion of state school students for at least 40 years.

This followed spending of £6m per year on outreach projects with schools, encouraging state school pupils to apply.

But Prof Richardson said that such work was separate from running a school and that the university should not take on activities that would “distract our time, energy and resources”.

The Oxford vice-chancellor also argued for the importance of free speech and for allowing university students to hear views they might find “objectionable”.

And she said she opposed both the government’s Prevent anti-extremism strategy and students who wanted to have “safe spaces”, where views they found offensive would not be allowed, on campus.

A Department for Education spokeswoman said: “There are already some excellent examples of universities sponsoring schools – they have expertise that can really help improve our education system, and it’s in their own interests to improve attainment in schools.

“With 1.25 million children in underperforming schools, we have put forward new proposals, asking how our world-leading higher education sector can help make more good school places available.

Academy rejects call for parent governors

An academy chain which has already scrapped all its parent governors, says it has no intention of reinstating them, despite the education secretary saying schools should have them.

Justine Greening told MPs on Wednesday that she was ditching plans to allow academy chains to operate without any parent governors.

She said academy chains should not think they did not need them.

But the E-Act chain says it has no plans to return to parent governors.

Speaking to the Education Select Committee, Ms Greening announced she wasabandoning her predecessor’s plan, which would have allowed academy trusts to operate without any parent governors, either in individual schools or on the board of trustees.

“I don’t think we should be saying that MATs [multi-academy trusts] don’t need to have parent governors,” she said.

“I think parent governors play a vital role. I was a governor, I’m not any more, but I was a governor for 15 years, maybe more, and parents played a vital role on the governing body.”

She told MPs she would not proceed with allowing trusts to have no parent governors, saying that “parents are part of how success gets delivered”.

Head teachers’ leader Russell Hobby backed the education secretary’s decision to drop the plan to remove parent governors, saying “common sense has prevailed”.

‘Ambassadors’ not governors

The plan to allow trusts to remove all parent governors is part of the White Paper on academies, published before the latest plans for another change of direction in the Green Paper on grammar schools.

But under existing academy rules, chains are not required to have parent governors in individual schools.

E-Act, which operates 23 schools across England, has already scrapped all its parent governors in schools.

These were replaced by parent “ambassadors” who do not have the powers of scrutiny held by governors.

They have a role “celebrating the academy’s achievements” rather than holding the school to account.

E-Act had itself faced questions over standards, when in 2014 the academy chain lost control of 10 of its schools after Ofsted inspectors raised serious concerns about their performance.

The levels of scrutiny of academy chains has remained controversial.

Ofsted chief Sir Michael Wilshaw has called for the education watchdog to be able to inspect academy chains, in the way that local education authority education services can be inspected.

E-Act said that the current arrangements improved “parental involvement” in their schools and that there were no plans to reintroduce parent governor roles that were removed earlier this year.

“One of the principal drivers of the changes we made to how our academies are governed was to enhance parental involvement in the life of our academies. This model is working,” said an E-Act spokesman.

Kolkata: The West Bengal government has rejected recommendations by a panel set up by its higher education department to determine the terms and conditions of employment of college teachers after it proposed that teachers be barred from talking to the media or express their views on public policy.

One of the panel’s key recommendations was that teachers would be barred from expressing their views on policies of both the state and central governments in the media. If accepted without modification, the proposals meant teachers would not be allowed to write in newspapers, share their views for being reported or appear on television shows.

But Partha Chatterjee, the state’s education minister, on Wednesday said on Twitter that the “allegation that the freedom of speech of university professors is being curbed… is a blatant lie”. He clarified that no such rule is to be implemented. The minister had earlier said that he had issues with several recommendations made by the panel.

Several organizations of university teachers had said they would take legal action if the state government implemented the new terms and conditions. Another of the panel’s key recommendations was to keep new recruits on probation for two years, which, according to some teachers, is too long. The panel had also recommended that teachers should be barred from offering private tuition or taking up part-time assignments.

Rules for attendance were proposed to be tightened with colleges being asked to create infrastructure for recording attendance through biometric devices. “Every college shall maintain a biometric system of attendance for recording the attendance and departure of all employees,” the panel had proposed. Also, the age of retirement for teachers was proposed to be set at 62.

The proposals of the panel are at variance with what the minister had expected, said a key official in the higher education department, who asked not to be named. The bar on talking to media got more attention than many other contentious proposals, he said, adding that these new rules are not to be implemented anytime soon.
